Car accident 2, hit-and-run

It’s been quite unlucky for me this year. Things have not been well since the beginning of 2010. In just two months, I had two road accidents. The first one was a near-death experience, unlucky I was, but I was lucky to survive without any bruises even.

On 8 May 2010, I went for Iron Man 2 with a group of friends. Disappointing movie, everything is a big let let down, except the gorgeous Scarlett Johannson as the Black Widow.

Back to the accident. After watching the movie and grabbing our lunch at McD, I sent my friends back. Just when I was driving on my lane to go home, I saw a motorcycle entering into the road from left. The motorcycle went to my lane, and at that moment I foresaw an accident would be. I was driving pretty slow at that moment, and even slower when I saw that motorcycle coming towards my direction. Knowing I couldn’t avoid, I made several horn, but the motorcyclist wasn’t concentrating. She was looking at another direction. There were 3 under-age Malay girls without helmet on the bike.

I saw them hitting my poor Kelisa, and the one at the back of the motorcycle flew to my windscreen. I quickly got down from the car and checked if they were alright. The other poor girls went down on the right side of the road after hitting my car. They were crying and all. I asked them to wait aside. Some witnesses saw them wanted to flee away, but asked them to wait because they hit my car.

So when I parked my car aside and got down to check with them their condition, the main motorcyclist got scared and asked her mates to get on the bike and flee the scene. I looked at them helplessly, thinking if I should pursue them. In the end, I didn’t pursue them. It was believed that they were without license, not wearing helmet, three girls on the bike, and driving in the wrong side of the road. 4 traffic laws they broke.

Headlight, signal light, bumper, and front engine cover all gone case. My windscreen also cracked, though not exactly severe, because one of them flew on top of my car.

That same hour, I went to the traffic police station to make a report. After making the report, the Sargent questioned me a bit, then we went to the scene to take some pictures. He told me that he would send a request to the JPJ (Road Transport Department) to find out who’s the owner of the motorcycle.

Thinking that I could claim the third-party’s insurance, but in fact I couldn’t because the party at fault was a motorcycle. Here’s the fact about motorcycle insurance: if a motorcycle hits you, you can’t claim that party’s motor insurance. The insured amount is just not enough to cover the damage of your car, even if the motorcyclist is at fault.

I could only claim my own insurance, which I would lose the No Claim Discount (NCD) after claiming it.

After calculating the cost, it’s more reasonable for me to pay for the car damage instead of claiming my insurance and lose the NCD which had been accumulated for years.

So, just yesterday, my car returned after repair. It cost me RM500 to change the headlight and signal light (RM70 altogether, not original), and some adjustment on its cover and bumper.

Lessons learnt:

  1. When hit by a motorcyclist, check if he’s ok.
  2. If he is at fault, don’t let him run away. Try to get hold of him and negotiate.
  3. Request for repair cost from the motorcyclist. If he asks to claim his insurance or your own insurance, it’s impossible because you would lose your NCD.
  4. What traffic police can do most is just to give him the summon, that’s all.

In short, count yourself unlucky if you are hit by a motorbike. You will likely have to pay for the car damage by yourself.

    @hatebikers: No, you can’t claim. Sorry to hear this. Check which would be cheaper for your repair cost, whether to claim your own insurance and lose your NCD, or repair it out of your own pocket.

    no ,u can claim his insurance.as long as the motorbike fault,but oso make sure he got insurance cover.

    Have you tried before? I had enquired insurance company and was told I wouldn’t be able to claim even though it’s the biker’s fault.
